De fleste ville neppe oppfatte en melon som en oppfinnelse. Men den europeiske patentmyndigheten ser i \u00f8kende grad planter som oppfinnelser. Det er ikke bare ubegripelig, det er ogs\u00e5 problematisk.<\/p>\n

I Europa er det EPO – European Patent Office – som utsteder felles Europa-patenter. De utsteder for tiden patenter p\u00e5 mange planter. Det har bare den haken at patent p\u00e5 planter ikke er tillatt if\u00f8lge europas patentkonvensjon.<\/p>\n

Hvorfor ser vi da plutselig at det utstedes patenter p\u00e5 forskjellige typer brokkoli, melon og tomat i Europa?<\/p>\n

Oppdagelser eller oppfinnelser?<\/strong><\/p>\n

Artikkel 53 B i den europeiske patentkonvensjonen fastsl\u00e5r at patenter p\u00e5 planter ikke er tillatt. Det skyldes at man ikke oppfatter natur og planter som oppfinnelser. Selv nye og hittil ukjente plantearter vil alltid v\u00e6re oppdagelser.<\/p>\n

Dette skillet mellom oppdagelser og oppfinnelser st\u00e5r sentralt i patentlovgivningen.<\/p>\n

I artikkel 52 fremg\u00e5r det at patent kan tas p\u00e5 enhver oppfinnelse, og senere i artikkel 52 2 (a) kan man lese at patent aldri kan utstedes p\u00e5 oppdagelser. Allikevel har EPO alts\u00e5 valgt \u00e5 utstede patenter p\u00e5 blant annetnoen\u00a0 typer melon, brokkoli og tomat.<\/p>\n

\u00c5rsaken er at det n\u00e5 er mulig \u00e5 frambringe nye plantearter gjennom genmanipulasjon. Patenthaveren argumenterer for at de selv har «funnet opp» plantearter gjennom ikke-biologiske prosesser. Et eksempel er virksomheten Monsanto som har tatt patent p\u00e5 en type av melon som er resistent overfor sykdom CYSDV.<\/p>\n

Monsanto fors\u00f8kte i f\u00f8rste omgang \u00e5 ta patent p\u00e5 alt med melonen, inkludert dyrkeprosessen. Men da dyrkeprosessen besto av en enkel krysning mellom to typer meloner ble dette patentkravet kjent ugyldig i henhold til forbudet mot patent p\u00e5 biologiske prosesser. Til gjengjeld ga EPO Monsanto patent p\u00e5 selve planten samt frukt og fr\u00f8. Det betyr at Monsanto kan blokkere adgangen til s\u00e5korn som arver de genetiske egenskapene som skaper resistensen.<\/p>\n

Det store mysteriet er, hvordan resultatet av prosessen kan patenteres n\u00e5r selve prosessen ikke kan patenteres?<\/p>\n

EPO finansieres av patentutstedelser<\/strong><\/p>\n

EPOs utstedelseiver bunner kanskje i at finansieringen deres kommer fra patentutstedelser. Jo flere patenter de utsteder, jo flere penger kommer det i kassa. I tillegg til det finnes det ikke en uavhengig instans for \u00e5 kontrollere EPOs patenter.<\/p>\n

Det har i de seneste ti\u00e5rene v\u00e6rt en rivende utviklin, hvor hele matvaresystemet v\u00e5rt blir monopolisert av store multinasjonale virksomheter. Virksomheter som som Monsanto, Bayer og Syngenta har i dag rettigheter p\u00e5 en stor del av verdenens fr\u00f8 og dermed stor kontroll p\u00e5 matvareforsyningen v\u00e5r.<\/p>\n","protected":false},"excerpt":{"rendered":"
